By accessing or using Gift List Maker, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our service.

• You must be at least 13 years old to use this service
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account
• You must comply with all applicable laws and regulations

2. Service Description

Gift List Maker provides tools to help you:

• Create and manage gift lists for various occasions
• Share lists with friends, family, and contributors
• Coordinate group gift purchases
• Track gift preferences and recipient profiles
• Claim items to avoid duplicate purchases
• Manage surprise lists with reveal dates

We reserve the right to modify, suspend, or discontinue any part of the service at any time.

3. User Accounts and Security

Account Registration

• You must provide a valid email address
• You must create a secure password
• You may not impersonate others or create fake accounts
• One person may not maintain multiple accounts

Account Security

• You are responsible for all activity under your account
• You must notify us immediately of any unauthorized access
• You must not share your password or account access
• We are not liable for losses due to unauthorized use of your account

4. User Content and Conduct

Your Content

You retain ownership of content you create (lists, items, comments, insights). By posting content, you grant us a license to:

• Store, display, and transmit your content to provide the service
• Share your content with list participants based on their roles
• Create backups and cached copies for reliability

Prohibited Content and Conduct

You agree NOT to:

• Post illegal, harmful, threatening, or abusive content
• Harass, bully, or intimidate other users
• Violate intellectual property rights
• Spam or send unsolicited promotional content
• Attempt to gain unauthorized access to the service
• Interfere with or disrupt the service or servers
• Use automated tools (bots, scrapers) without permission
• Collect personal information about other users
• Use the service for commercial purposes without authorization

5. List Sharing and Collaboration

Share Codes

• Share codes grant access to anyone who has the code
• You are responsible for who you share codes with
• You can regenerate codes to revoke existing access
• We are not responsible for unauthorized sharing of codes

Roles and Permissions

• Owners: Full control over lists and items
• Co-Planners: Can manage items and see claims (for surprise lists)
• Contributors: Can claim items and add suggestions
• Recipients: Can view items but not claims (until reveal)

6. Gift Claims and Purchases

Important: Gift List Maker is a coordination tool only. We do NOT:

• Process payments or transactions
• Sell or fulfill gift items
• Guarantee item availability or pricing
• Provide refunds or returns
• Warranty or endorse any products

When you claim an item, you are committing to purchase it yourself through the retailer. All purchases, returns, and disputes are between you and the retailer.

We are not responsible for:

• Accuracy of item information scraped from external sites
• Price changes or item availability
• Disputes between gift givers and recipients
• Quality or suitability of gifts purchased

7. Intellectual Property

The Gift List Maker service, including its design, features, and code, is owned by us and protected by copyright, trademark, and other intellectual property laws.

• You may not copy, modify, or reverse-engineer our service
• Our name, logo, and branding are trademarks and may not be used without permission
• You may not frame or embed our service without authorization
• Open-source components are licensed separately (see GitHub repository)

8. Disclaimers and Limitation of Liability

Service Provided "As Is"

Gift List Maker is provided "as is" without warranties of any kind, either express or implied, including but not limited to:

• Availability, reliability, or uptime
• Accuracy or completeness of information
• Freedom from errors, bugs, or security vulnerabilities
• Compatibility with your devices or browsers

Limitation of Liability

To the fullest extent permitted by law, we are NOT liable for:

• Loss of data or content
• Service interruptions or downtime
• Indirect, incidental, or consequential damages
• Disputes between users
• Third-party actions or content
• Loss of profits or goodwill

9. Indemnification

You agree to indemnify and hold harmless Gift List Maker, its developers, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of others
• Content you post or share

10. Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse or harassment of other users
• Non-payment (if paid features are introduced)
• Any reason, with or without notice

You may delete your account at any time through your profile settings. Upon termination, your data will be deleted as described in our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the service. Your continued use after changes constitutes acceptance of the updated Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the United States. Any disputes will be resolved in accordance with those laws.

Before filing any legal action, you agree to attempt to resolve disputes informally by contacting us first.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
